[DA’S MEDIA STATEMENT] Cape & Islands District Attorney Robert J. Galibois announced today that Zachary Fena, 49 years old, of Centerville, MA, has been charged for his involvement in the death of 48-year-old Mario Da Paixao Andrade, of Hyannis, MA. On April 3, 2025, at approximately 5:26 p.m., the Massachusetts State Police Yarmouth barracks received multiple calls regarding a two-car crash that occurred on Route 6, at mile marker 84.2, in the Town of Harwich. Troopers arrived on scene and observed two vehicles with debris scattered across both the eastbound and westbound lanes. Vehicle One (Zachary Fena) was observed at final rest in the median, separating the eastbound and westbound lanes, facing west. This vehicle was observed with heavy front-end damage. Vehicle Two (victim) was observed at final rest in the eastbound breakdown lane, facing west, up against the guardrail. This vehicle was also observed with heavy front-end damage. Witnesses interviewed on scene reported observing Vehicle One swerving multiple times, with rapid vehicle speed changes, prior to crossing the median, from the eastbound lane into the westbound lane, and striking Vehicle Two head-on. The sole occupant of Vehicle One was transported to Cape Cod Hospital by Harwich Fire Department for further evaluation. As a result of the on-scene investigation, probable cause was developed that the operator of Vehicle One was operating the motor vehicle under the influence of alcohol. Vehicle One operator was subsequently placed in custody at Cape Cod Hospital. The sole occupant of Vehicle Two was determined to be no longer viable for resuscitation on scene by members of the Harwich Fire Department. Members of the State Police Detective Unit, assigned to the Cape & Islands District Attorney’s office, MA State Police, Massachusetts State Police Collision Analysis Reconstruction Section, and the Massachusetts State Police Crime Scene Section, Harwich Police & Fire Departments, and other assisting agencies were on scene and will continue conducting the investigation. Zachary Fena is charged with manslaughter while OUI, motor vehicle homicide OUI- Liquor or .08% negligent, OUI, negligent operation of motor vehicle, and marked lanes violation. Mr. Fena was arraigned out of the Orleans District Court. The Commonwealth requested $10,000 bail. The court ordered $5,000 with conditions of release. Mr. Fena is scheduled on May 5, 2025, for probable cause hearing in the Orleans District Court. District Attorney Galibois’s thoughts are with the family and loved ones of the individual involved during this very sad time. This investigation is on-going. The Cape & Islands District Attorney’s Office will make no further comment at this time. The Cape & Islands District Attorney’s Office reiterates that all defendants are presumed innocent.
